The Local Government Act 1995 enables Western Australian local governments to make local laws which are considered necessary for the good government of their districts.

The City of Mandurah has a number of local laws that govern activities on land that is owned or managed by the City, as well as certain activities conducted on private land within the District.

These local laws are enforceable by the City and the City may authorise officers to enforce the local laws on its behalf.

All local laws undergo periodical review, at a minimum of every 8 years. The local laws currently under review and open for submissions from the public are listed below:

    At its meeting of 23 July Council resolved to adopt the proposed Cat Local Law 2019 for advertising. 

    Proposed Cat Local Law 2019

    Purpose:  To make provisions about the keeping of cats, to control the number of cats that can be kept, the places where cats can be kept and prescribe areas in which cats are prohibited.

    Effect:  To extend the control over cats which exist under the Cat Act 2011.

    The local law addresses cats through:

    • Nuisance – allows the issuance of a notice to abate nuisance (potential confinement for up to 28 days).
    • Number of Cats – prescribes that no more than 2 cats are permitted to be kept without a specific approval.
    • Prohibited Areas – provides for offences for cats entering into scheduled City owned or managed land.

    At is meeting of 27 August Council resolved to adopt the proposed Animals, Environment and Nuisance Amendment Local Law No.2 2019 for advertising.

    Proposed Animals, Environment & Nuisance Amendment Local Law No. 2 2019

    Purpose: The Animals Environment and Nuisance Local Law 2010 provides protection against nuisances and hazards for the following areas; Keeping of Animals (birds, farm animals and bee keeping), Building, Development and Land Care and Nuisances and Dangerous Things (including Pest Plants).

    Effect:  to ensure that the City of Mandurah Animals, Environment & Nuisance Local Law 2010 is as clear and effective as possible.

    • Only 1 amendment has been proposed and it is intended to make clear how the City may vary permits for the keeping of farm animals.

    Proposed Animals, Environment & Nuisance Amendment Local Law 2019

    Purpose:  to amend provisions within the City of Mandurah Animals, Environment & Nuisance Local Law 2010.

    Effect:  to ensure that the City of Mandurah Animals, Environment & Nuisance Local Law 2010 is as clear and effective as possible.

    • Amendments to the local law are proposed to reduce red tape through reducing the need for approvals whilst still retaining and ability to enforce requirements where required.

    • The proposed amendments remove duplication with other legislation and provide increased flexibility.

    • The changes bring the local law up to date with the City’s preferred approach to legislation enforcement.

    Proposed Fencing Amendment Local Law 2018

    Purpose:  to amend provisions within the City of Mandurah Fencing Local Law 2015.

    Effect:  to ensure that the City of Mandurah Fencing Local Law 2015 is as clear and effective as possible.

    • Amendments are proposed to differentiate between the fencing requirements of residential properties with different density requirements.  

    • Terminology updates.

    • Add clarity to provisions within principle local law.

    Proposed Proposed Jetties, Waterways & Marina Local Law 2018

    Purpose:  to amend provisions within the City of Mandurah Jetties, Waterways & Marina Local Law 2010.

    Effect:  to ensure that the City of Mandurah Jetties, Waterways & Marina Local Law 2010 Local Law 2010 is as clear and effective as possible.

    This amendment local law:

    • clarifies that vessels are not to be moored, anchored, fastened or left alongside a public jetty or public foreshore for an extended period of time (unless there is a sufficient reason ie. the vessel is in distress or where the approval of the City has first been obtained);

    • inserts a new clause which allows the City to close or restrict access to public jetties (for purposes such as public works, public safety, the holding of a function etc.); and

    • clarifies that the requirement for an owner to maintain a jetty, pontoon or waterway-edge wall includes doing so as to avoid it becoming dilapidated, unsightly, unsafe or otherwise unfit for its purpose and must comply with any notice given by the City requiring repair.

    Proposed Cemeteries Amendment Local Law 2019

    Purpose:  to amend provisions within the City of Mandurah Cemeteries Local Law 2010.

    Effect:  to ensure that the City of Mandurah Cemeteries Local Law 2010 is as clear and effective as possible.

    This amendment local law inserts a definition for “standard grave” into the principle local law in order to add clarity.
